Joseph E. Kurd on his oath deposeth and says. I was in Charleston on Monday the 28th day of March 1864 was in the Banking House of Morton & Clement at the time the firing commenced soon after saw Elsbury Hanks run up close to a soldier and shoot him the soldiers name was Swain who died a short time after the soldier fell immediately after Hanks shot him. I also saw Henderson OHair shoot 2 or 3 times at a Solider whose name was Near who has since died. Saw John Frazier shoot at said Near while he was lying on the ground after he was shot. Frazier was on his horse at the time he was shooting there was another man standing by Henderson OHair at the time he was shooting at Near who was also shooting at the same man. Saw several of them shooting at the soldiers About ten minutes before the firing commenced I saw Henderson OHair and Frank Daugherty standing at the east end of Judge Edward office saw OHair hand Daugherty some money and go with Daugherty to the gate and point up towards Owens corner. Daughery went on up that way and I saw nothing more of him. I saw as many as four or more guns taken out of a wagon standing near the Eastern Gate of the Court yard. Saw one of the men shot one of these guns towards the soldiers
